1. Introduction
Welcome to Home Elements ("we," "our," "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, products, and services. By purchasing our products or using our services, you agree to these Terms. If you do not agree, please refrain from using our services.
2. Definitions
• "Products" refer to furniture and related items offered for sale, intended for residential (home) use only.
• "Services" include delivery, assembly, and other support services we provide.
• "Customer" refers to any individual or entity purchasing our Products or Services.
3. Home Use Only
• Our Products are designed and manufactured for home use only.
• Use of the Products in commercial, industrial, or other non-residential settings voids any warranties and may limit liability under these Terms.
• We are not responsible for any damages, defects, or failures resulting from inappropriate use or installation of the Products in non-residential environments.
4. Orders and Payments
• All orders are subject to acceptance and availability.
• Prices listed are in New Zealand Dollars (NZD) and include GST unless stated otherwise.
• Payment must be made in full at the time of purchase. We accept Visa, Mastercard, bank transfers, etc.
• We reserve the right to refuse or cancel any order due to errors, fraudulent activity, or other unforeseen issues.
5. Delivery and Assembly
• Delivery timelines provided are estimates and may vary due to external factors.
• Customers are responsible for providing accurate delivery information. Additional costs resulting from incorrect details are the customer’s responsibility.
• Assembly services, if included or purchased, will be provided as per the agreement.
• Delivery and assembly fees are non-refundable.
6. Returns and Refunds
No Returns for Change of Mind:
• We do not accept returns or provide refunds for change-of-mind purchases. Please choose carefully before making a purchase.
• Returns are only accepted for products that are faulty, damaged, or not as described, in accordance with the Consumer Guarantees Act 1993.
Measurement and Delivery Issues:
• Please ensure you measure doorways, hallways, and any other openings through which the furniture will need to pass. We are not responsible for returns or exchanges if the product does not fit due to incorrect measurements.
• We will not attempt delivery if there is any risk of damage from trying to fit items through doorways, hallways, or other openings, or over fences.
• In special circumstances, if we agree to a return, a restocking fee of 15% will apply. The cost of return shipping will be the responsibility of the buyer.
Refunds for Faulty or Defective Products:
• Refunds for faulty or defective items will be processed via bank transfer, using the original purchase amount (excluding any non-refundable delivery, assembly fees, or credit card surcharge).
• Credit card surcharge refunds will not be issued as part of the refund.
• Delivery charges, assembly fees, and any costs associated with delivering items upstairs (if applicable) are non-refundable.
Custom and Special-Order Items:
• Custom or special-order items are non-returnable and non-refundable unless the items are defective.
• A 30% deposit is required for customized products, and this deposit is non-transferable and non-refundable once paid.
Order Cancellations:
• Non-Customized Products: We charge 30% of the full purchase price as a deposit, and full payment is required before delivery. You may cancel a non-customized item within 7 days before delivery without incurring any fees. Cancellations after this period will be subject to a 15% restocking fee based on the full purchase price.
• Customized Products: A 30% deposit is required for customized products, which is non-refundable and non-transferable.
7. Deposit Policy
• For non-customized products, a 30% deposit is required at the time of order. The remaining 70% is due before delivery.
• For customized products, a 30% deposit is required at the time of order, which is non-refundable and non-transferable once paid.
• If a cancellation is made after the specified period for non-customized products (7 days before delivery), the deposit may be subject to the cancellation fee as outlined in the Order Cancellations section.
8. Warranty
• Our Products are covered by a warranty ranging from one to five years against manufacturing defects, depending on the product category. Customers are encouraged to review their specific product documentation or contact customer support for the applicable warranty period.
• This warranty does not cover normal wear and tear, misuse, improper maintenance, accidental damage, or unauthorized alterations.
• The warranty applies exclusively to residential use. Products used in non-residential, commercial, or industrial settings are not covered.
• To make a warranty claim, customers must provide proof of purchase, a detailed description of the issue, and photographs if applicable.
• Warranty claims must be made within the applicable warranty period. The warranty period begins from the date of purchase unless otherwise specified.
9. Limitation of Liability
• We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our Products or Services.
• Our total liability is limited to the purchase price of the affected Product or Service.
• We are not responsible for damages caused by improper use, failure to follow care instructions or use in non-residential settings.
10. Privacy Policy
• We collect and process personal data in accordance with the Privacy Act 2020. By using our Services, you consent to this processing.
• Personal information may be used to process orders, improve our services, and communicate with customers.

11. Intellectual Property
• All content, designs, trademarks, and intellectual property associated with our Products and Services are owned by or licensed to us. Unauthorized use is prohibited.
• Reproduction, distribution, or modification of any content without permission is strictly prohibited.
12. Governing Law
• These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.

14. Promotions and Discounts
• Promotions and discounts are subject to specific terms and conditions, which will be provided at the time of the offer.
• Discounts cannot be combined unless explicitly stated.
• Promotions may be withdrawn or altered at any time without prior notice.
15. Customer Responsibilities
• Customers must inspect items upon delivery. Any damages or defects must be reported within 24 hours.
• Proper care and maintenance of the Products are required to ensure longevity. Care instructions are provided with the Products.
16. Force Majeure
• We are not responsible for delays or failures caused by events beyond our control, including natural disasters, labor strikes, or transportation disruptions.
